We offer advice, resources and assistance with all aspects of planning, for parents of children with special needs:
- When handicapped children become adults: As a parent, you have been capable of providing for your handicapped child, taking care of daily needs, managing health care, managing finances and all other matters on behalf of your child. When your child turns 18 and enters adulthood, you will not have the legal authority to do some of the things you have done over the years. It is essential to establish a guardianship and conservatorship so that you may continue to meet your disabled child’s needs.
- Care for your child in the future: As life progresses, there will come a time when you will not be capable of providing adequate care for your handicapped child. It is important to plan for these needs in advance to avoid crisis situations. We can help you appoint guardians who will continue to care for your child, determine if an assisted living facility is appropriate and help assess costs of future care.
- Estate planning and benefit protection: Because you were capable of providing for your child previously, the cost of care was not an issue. However, as the need arises for care from outside the family, additional funds will be necessary. We can help you proactively plan for these future costs by establishing special needs trusts. Under a special needs trust, inheritance and other assets can provide for the care of a child with a disability and avoid jeopardizing government benefits, such as Medicaid or Social Security.
